国务院办公厅关于加快推进社会信用体系建设构建以信用为基础的新型监管机制的指导意见

各省、自治(zhi)区(qu)、直(zhi)辖市人(ren)民(min)政府,国务院各部委、各直(zhi)属机构:

  为加(jia)强社会信(xin)用(yong)体系(xi)建(jian)设,深入推(tui)进“放管(guan)服”改革(ge),进一步发(fa)挥信(xin)用(yong)在创新监(jian)管(guan)机制、提高监(jian)管(guan)能(neng)力(li)和水平方(fang)面(mian)的基础性(xing)作用(yong),更好激发(fa)市场主体活力(li),推(tui)动高质量发(fa)展,经国务院(yuan)同(tong)意,现提出如下意见。

  一、总体要(yao)求

  以习近平新时代中(zhong)国特(te)色(se)社会主义思想为指导,深入贯(guan)彻落实党的(de)十九(jiu)大和十九(jiu)届(jie)二中(zhong)、三中(zhong)全(quan)(quan)会精神,按照依法依规、改革创新、协同(tong)共(gong)治的(de)基本原则,以加强信用监(jian)管为着(zhe)力点,创新监(jian)管理念(nian)、监(jian)管制(zhi)度和监(jian)管方(fang)式,建(jian)立(li)健全(quan)(quan)贯(guan)穿市(shi)场(chang)主体全(quan)(quan)生命周期,衔接事(shi)前、事(shi)中(zhong)、事(shi)后全(quan)(quan)监(jian)管环节的(de)新型监(jian)管机制(zhi),不断提升监(jian)管能力和水平,进一步(bu)规范市(shi)场(chang)秩序,优化营商环境,推动(dong)高质(zhi)量发展(zhan)。

  二(er)、创(chuang)新事前环节信(xin)用监管

  (一)建立健(jian)全信(xin)用(yong)(yong)承(cheng)(cheng)(cheng)(cheng)诺(nuo)(nuo)制度(du)。在办(ban)理适用(yong)(yong)信(xin)用(yong)(yong)承(cheng)(cheng)(cheng)(cheng)诺(nuo)(nuo)制的(de)行(xing)政许(xu)可(ke)事项时(shi),申请人(ren)承(cheng)(cheng)(cheng)(cheng)诺(nuo)(nuo)符合审批(pi)条件并提(ti)交有关材料(liao)的(de),应(ying)予即(ji)时(shi)办(ban)理。申请人(ren)信(xin)用(yong)(yong)状况(kuang)较好、部分申报材料(liao)不齐备但书(shu)面承(cheng)(cheng)(cheng)(cheng)诺(nuo)(nuo)在规定期限内提(ti)供的(de),应(ying)先(xian)行(xing)受理,加快办(ban)理进(jin)度(du)。书(shu)面承(cheng)(cheng)(cheng)(cheng)诺(nuo)(nuo)履约(yue)情况(kuang)记入(ru)信(xin)用(yong)(yong)记录(lu),作(zuo)为事中、事后(hou)监管的(de)重要依据(ju),对不履约(yue)的(de)申请人(ren),视情节实施惩戒(jie)。要加快梳(shu)理可(ke)开展信(xin)用(yong)(yong)承(cheng)(cheng)(cheng)(cheng)诺(nuo)(nuo)的(de)行(xing)政许(xu)可(ke)事项,制定格式规范的(de)信(xin)用(yong)(yong)承(cheng)(cheng)(cheng)(cheng)诺(nuo)(nuo)书(shu),并依托各(ge)级(ji)信(xin)用(yong)(yong)门户网站向社会(hui)(hui)公开。鼓(gu)励市场主体主动向社会(hui)(hui)作(zuo)出信(xin)用(yong)(yong)承(cheng)(cheng)(cheng)(cheng)诺(nuo)(nuo)。支持行(xing)业协会(hui)(hui)商会(hui)(hui)建立健(jian)全行(xing)业内信(xin)用(yong)(yong)承(cheng)(cheng)(cheng)(cheng)诺(nuo)(nuo)制度(du),加强行(xing)业自律。(各(ge)地区各(ge)部门按职责(ze)分别负责(ze))

  (二)探索开(kai)展(zhan)经(jing)营(ying)者(zhe)准(zhun)入前(qian)诚(cheng)(cheng)信教(jiao)育(yu)(yu)。充分利用各级各类政务(wu)(wu)(wu)服(fu)务(wu)(wu)(wu)窗口,广泛(fan)开(kai)展(zhan)市(shi)(shi)场(chang)主体(ti)守法诚(cheng)(cheng)信教(jiao)育(yu)(yu)。为(wei)市(shi)(shi)场(chang)主体(ti)办(ban)理注(zhu)册、审批、备案等相(xiang)关业(ye)务(wu)(wu)(wu)时(shi),适(shi)时(shi)开(kai)展(zhan)标准(zhun)化(hua)(hua)、规范化(hua)(hua)、便捷化(hua)(hua)的法律知识和信用知识教(jiao)育(yu)(yu),提(ti)高经(jing)营(ying)者(zhe)依法诚(cheng)(cheng)信经(jing)营(ying)意识。开(kai)展(zhan)诚(cheng)(cheng)信教(jiao)育(yu)(yu)不(bu)得收费(fei),也不(bu)得作(zuo)为(wei)市(shi)(shi)场(chang)准(zhun)入的必要条件。(各地区各部门按职责(ze)(ze)分别负责(ze)(ze))

  (三(san))积极拓展(zhan)信(xin)用(yong)(yong)报(bao)告(gao)应(ying)用(yong)(yong)。鼓励各(ge)类市场(chang)主体在生(sheng)产经营活动中更广泛、主动地应(ying)用(yong)(yong)信(xin)用(yong)(yong)报(bao)告(gao)。在政(zheng)府采(cai)购、招标投标、行(xing)政(zheng)审批(pi)、市场(chang)准(zhun)入、资质审核(he)等(deng)事项中,充(chong)分发(fa)挥公共信(xin)用(yong)(yong)服(fu)务机构和第(di)三(san)方(fang)信(xin)用(yong)(yong)服(fu)务机构出具的(de)信(xin)用(yong)(yong)报(bao)告(gao)作用(yong)(yong)。探索建立全(quan)国(guo)统一的(de)信(xin)用(yong)(yong)报(bao)告(gao)标准(zhun),推动信(xin)用(yong)(yong)报(bao)告(gao)结果实现异(yi)地互认。(发(fa)展(zhan)改革委、人(ren)民银行(xing)牵头,各(ge)地区各(ge)部门按职责(ze)(ze)分别负(fu)责(ze)(ze))

  三、加强事中环节(jie)信用监管

  (四)全(quan)面建(jian)立市场(chang)(chang)主体(ti)信(xin)(xin)用(yong)(yong)记(ji)(ji)(ji)录(lu)。根(gen)据权责(ze)清单建(jian)立信(xin)(xin)用(yong)(yong)信(xin)(xin)息(xi)采集目录(lu),在办(ban)理(li)注册登(deng)记(ji)(ji)(ji)、资质审核(he)、日常(chang)监(jian)管、公共服务等过(guo)程中(zhong),及(ji)时(shi)、准确、全(quan)面记(ji)(ji)(ji)录(lu)市场(chang)(chang)主体(ti)信(xin)(xin)用(yong)(yong)行(xing)为(wei),特别是(shi)将失(shi)信(xin)(xin)记(ji)(ji)(ji)录(lu)建(jian)档留(liu)痕,做到(dao)可(ke)(ke)查可(ke)(ke)核(he)可(ke)(ke)溯。(各(ge)地区各(ge)部门按职(zhi)责(ze)分别负(fu)责(ze))完(wan)善(shan)法人(ren)和非法人(ren)组织统一社会(hui)信(xin)(xin)用(yong)(yong)代(dai)码制(zhi)度,以统一社会(hui)信(xin)(xin)用(yong)(yong)代(dai)码为(wei)标识,整(zheng)合形(xing)成完(wan)整(zheng)的(de)市场(chang)(chang)主体(ti)信(xin)(xin)用(yong)(yong)记(ji)(ji)(ji)录(lu),并通(tong)过(guo)“信(xin)(xin)用(yong)(yong)中(zhong)国(guo)”网站、国(guo)家(jia)企业信(xin)(xin)用(yong)(yong)信(xin)(xin)息(xi)公示系统或中(zhong)国(guo)政府网及(ji)相关部门门户网站等渠道依法依规向社会(hui)公开。完(wan)成12315市场(chang)(chang)监(jian)管投(tou)诉举报热线和信(xin)(xin)息(xi)化平台整(zheng)合工(gong)作(zuo),大力(li)开展消(xiao)(xiao)费投(tou)诉公示,促(cu)进经营者落实消(xiao)(xiao)费维(wei)权主体(ti)责(ze)任(ren)。(发展改革委、市场(chang)(chang)监(jian)管总(zong)局负(fu)责(ze))

  (五)建立健全(quan)信(xin)用信(xin)息(xi)(xi)自愿(yuan)注(zhu)册(ce)机(ji)制。鼓(gu)励市场主体在“信(xin)用中(zhong)国”网(wang)站或其他渠(qu)道上自愿(yuan)注(zhu)册(ce)资质证照(zhao)、市场经营、合同履约(yue)、社会(hui)公益等信(xin)用信(xin)息(xi)(xi),并对(dui)信(xin)息(xi)(xi)真(zhen)实性公开(kai)作(zuo)出信(xin)用承诺(nuo),授(shou)权网(wang)站对(dui)相关信(xin)息(xi)(xi)进行(xing)整(zheng)合、共(gong)享与应用。经验证的自愿(yuan)注(zhu)册(ce)信(xin)息(xi)(xi)可作(zuo)为(wei)开(kai)展信(xin)用评价(jia)和生成信(xin)用报告的重(zhong)要依据。(发(fa)展改革委牵头(tou),各部(bu)门(men)按职(zhi)责分别负(fu)责)

  (六)深入开展公共(gong)(gong)信(xin)(xin)(xin)用(yong)(yong)(yong)综(zong)合(he)评(ping)(ping)价。全(quan)国信(xin)(xin)(xin)用(yong)(yong)(yong)信(xin)(xin)(xin)息共(gong)(gong)享平台(tai)要(yao)加强与相关(guan)(guan)部(bu)(bu)门的(de)协同配合(he),依法(fa)依规整(zheng)合(he)各类信(xin)(xin)(xin)用(yong)(yong)(yong)信(xin)(xin)(xin)息,对市场主体开展全(quan)覆盖、标准化、公益性的(de)公共(gong)(gong)信(xin)(xin)(xin)用(yong)(yong)(yong)综(zong)合(he)评(ping)(ping)价,定期将评(ping)(ping)价结果推送至相关(guan)(guan)政府(fu)部(bu)(bu)门、金融机构、行(xing)业(ye)协会商会参考使(shi)用(yong)(yong)(yong),并依照有关(guan)(guan)规定向社(she)会公开。推动相关(guan)(guan)部(bu)(bu)门利用(yong)(yong)(yong)公共(gong)(gong)信(xin)(xin)(xin)用(yong)(yong)(yong)综(zong)合(he)评(ping)(ping)价结果,结合(he)部(bu)(bu)门行(xing)业(ye)管理数(shu)据,建(jian)立行(xing)业(ye)信(xin)(xin)(xin)用(yong)(yong)(yong)评(ping)(ping)价模(mo)型,为信(xin)(xin)(xin)用(yong)(yong)(yong)监管提供更精(jing)准的(de)依据。(发展改革委(wei)牵头,各部(bu)(bu)门按(an)职责(ze)分别(bie)负责(ze))

  (七)大力推进(jin)信(xin)用(yong)(yong)(yong)分(fen)级(ji)分(fen)类监(jian)管。在充分(fen)掌(zhang)握(wo)信(xin)用(yong)(yong)(yong)信(xin)息、综合(he)研判信(xin)用(yong)(yong)(yong)状况的基(ji)础上,以公(gong)共信(xin)用(yong)(yong)(yong)综合(he)评价(jia)结果(guo)、行业信(xin)用(yong)(yong)(yong)评价(jia)结果(guo)等为依(yi)(yi)据(ju)(ju),对(dui)监(jian)管对(dui)象进(jin)行分(fen)级(ji)分(fen)类,根据(ju)(ju)信(xin)用(yong)(yong)(yong)等级(ji)高(gao)(gao)低采取差(cha)异化的监(jian)管措施。“双随机、一公(gong)开(kai)”监(jian)管要(yao)与信(xin)用(yong)(yong)(yong)等级(ji)相结合(he),对(dui)信(xin)用(yong)(yong)(yong)较好、风险较低的市(shi)场主体,可合(he)理(li)降低抽(chou)查(cha)(cha)比(bi)例和(he)(he)频(pin)次,减少对(dui)正(zheng)常生(sheng)产(chan)经营的影响;对(dui)信(xin)用(yong)(yong)(yong)风险一般的市(shi)场主体,按常规比(bi)例和(he)(he)频(pin)次抽(chou)查(cha)(cha);对(dui)违法(fa)失信(xin)、风险较高(gao)(gao)的市(shi)场主体,适(shi)当提高(gao)(gao)抽(chou)查(cha)(cha)比(bi)例和(he)(he)频(pin)次,依(yi)(yi)法(fa)依(yi)(yi)规实行严管和(he)(he)惩(cheng)戒(jie)。(各地区(qu)各部(bu)门(men)按职责分(fen)别(bie)负责)

  四(si)、完(wan)善事后环节信用(yong)监管

  (八)健全失(shi)信联合(he)惩(cheng)(cheng)戒对(dui)象认(ren)(ren)定机制。有关部(bu)门(men)依(yi)据(ju)在(zai)事前、事中监管(guan)环节获取并认(ren)(ren)定的(de)(de)(de)失(shi)信记(ji)录,依(yi)法(fa)(fa)依(yi)规建立健全失(shi)信联合(he)惩(cheng)(cheng)戒对(dui)象名(ming)单制度。以(yi)相关司法(fa)(fa)裁判、行(xing)政处罚、行(xing)政强(qiang)制等处理(li)结果为依(yi)据(ju),按(an)程(cheng)序将涉(she)及性质恶劣(lie)、情节严(yan)(yan)重、社会危害较大的(de)(de)(de)违(wei)法(fa)(fa)失(shi)信行(xing)为的(de)(de)(de)市(shi)场主体纳入失(shi)信联合(he)惩(cheng)(cheng)戒对(dui)象名(ming)单。加快(kuai)完善相关管(guan)理(li)办法(fa)(fa),明确认(ren)(ren)定依(yi)据(ju)、标(biao)(biao)准、程(cheng)序、异议申诉(su)和退出机制。制定管(guan)理(li)办法(fa)(fa)要(yao)充分(fen)征求社会公众(zhong)意(yi)见,出台的(de)(de)(de)标(biao)(biao)准及其(qi)具体认(ren)(ren)定程(cheng)序以(yi)适当方式(shi)向(xiang)社会公开。支持(chi)有关部(bu)门(men)根据(ju)监管(guan)需要(yao)建立重点关注对(dui)象名(ming)单制度,对(dui)存在(zai)失(shi)信行(xing)为但(dan)严(yan)(yan)重程(cheng)度尚未达到失(shi)信联合(he)惩(cheng)(cheng)戒对(dui)象认(ren)(ren)定标(biao)(biao)准的(de)(de)(de)市(shi)场主体,可实施与其(qi)失(shi)信程(cheng)度相对(dui)应(ying)的(de)(de)(de)严(yan)(yan)格监管(guan)措施。(各部(bu)门(men)按(an)职责(ze)分(fen)别(bie)负责(ze))

  (九)督促失信(xin)(xin)市(shi)场主(zhu)(zhu)体限期(qi)整改。失信(xin)(xin)市(shi)场主(zhu)(zhu)体应(ying)当(dang)在规定期(qi)限内(nei)认(ren)真整改,整改不(bu)到位的(de),按(an)照“谁认(ren)定、谁约(yue)谈(tan)”的(de)原则,由认(ren)定部(bu)门依法依规启动提示(shi)(shi)约(yue)谈(tan)或(huo)警示(shi)(shi)约(yue)谈(tan)程(cheng)序,督促失信(xin)(xin)市(shi)场主(zhu)(zhu)体履行相关义务、消除不(bu)良影响。约(yue)谈(tan)记录记入失信(xin)(xin)市(shi)场主(zhu)(zhu)体信(xin)(xin)用记录,统一(yi)归集(ji)后纳入全国信(xin)(xin)用信(xin)(xin)息共(gong)享(xiang)平(ping)台。大力(li)推进(jin)(jin)重点领(ling)域失信(xin)(xin)问题专项治理(li),采取有力(li)有效措施(shi)加快推进(jin)(jin)整改。(各部(bu)门按(an)职责分别负(fu)责)

  (十)深(shen)入开(kai)展失信(xin)(xin)联(lian)合(he)惩(cheng)(cheng)戒(jie)(jie)(jie)。加(jia)快(kuai)构(gou)建跨(kua)(kua)地区、跨(kua)(kua)行(xing)(xing)业、跨(kua)(kua)领域(yu)的(de)失信(xin)(xin)联(lian)合(he)惩(cheng)(cheng)戒(jie)(jie)(jie)机(ji)制(zhi),从根本上解决失信(xin)(xin)行(xing)(xing)为(wei)反复(fu)出现、易地出现的(de)问题(ti)。依(yi)法依(yi)规(gui)建立联(lian)合(he)惩(cheng)(cheng)戒(jie)(jie)(jie)措(cuo)(cuo)施清(qing)单,动态更(geng)新(xin)并向社会公开(kai),形(xing)成行(xing)(xing)政(zheng)性(xing)、市场(chang)性(xing)和行(xing)(xing)业性(xing)等(deng)惩(cheng)(cheng)戒(jie)(jie)(jie)措(cuo)(cuo)施多管齐下,社会力(li)量广(guang)泛(fan)参与的(de)失信(xin)(xin)联(lian)合(he)惩(cheng)(cheng)戒(jie)(jie)(jie)大(da)格局。重(zhong)点(dian)实施惩(cheng)(cheng)戒(jie)(jie)(jie)力(li)度(du)大(da)、监管效(xiao)果好的(de)失信(xin)(xin)惩(cheng)(cheng)戒(jie)(jie)(jie)措(cuo)(cuo)施,包(bao)括依(yi)法依(yi)规(gui)限制(zhi)失信(xin)(xin)联(lian)合(he)惩(cheng)(cheng)戒(jie)(jie)(jie)对象股票(piao)发行(xing)(xing)、招(zhao)标(biao)(biao)投标(biao)(biao)、申请财政(zheng)性(xing)资金(jin)项目、享受税收优惠等(deng)行(xing)(xing)政(zheng)性(xing)惩(cheng)(cheng)戒(jie)(jie)(jie)措(cuo)(cuo)施,限制(zhi)获得授信(xin)(xin)、乘坐(zuo)飞机(ji)、乘坐(zuo)高等(deng)级(ji)列(lie)车和席次等(deng)市场(chang)性(xing)惩(cheng)(cheng)戒(jie)(jie)(jie)措(cuo)(cuo)施,以及通报批评、公开(kai)谴责(ze)(ze)等(deng)行(xing)(xing)业性(xing)惩(cheng)(cheng)戒(jie)(jie)(jie)措(cuo)(cuo)施。(发展改革(ge)委牵头,各地区各部门按职责(ze)(ze)分别负责(ze)(ze))

  (十一)坚决依法依规实施(shi)市(shi)(shi)(shi)场和行(xing)(xing)业(ye)禁入措施(shi)。以食品药品、生(sheng)态(tai)环境、工程质量、安(an)(an)全(quan)生(sheng)产(chan)、养老托幼、城市(shi)(shi)(shi)运(yun)行(xing)(xing)安(an)(an)全(quan)等(deng)与人民群众(zhong)生(sheng)命(ming)财产(chan)安(an)(an)全(quan)直接(jie)相(xiang)关的领域为重点,实施(shi)严格监(jian)管,加大惩戒(jie)力度。对(dui)拒不(bu)履(lv)行(xing)(xing)司法裁判或行(xing)(xing)政(zheng)处(chu)罚决定(ding)、屡犯不(bu)改、造(zao)成(cheng)重大损(sun)失的市(shi)(shi)(shi)场主体及其相(xiang)关责任人,坚决依法依规在一定(ding)期限内实施(shi)市(shi)(shi)(shi)场和行(xing)(xing)业(ye)禁入措施(shi),直至永远逐出市(shi)(shi)(shi)场。(发展改革委牵(qian)头(tou),各地区(qu)各部(bu)门按(an)职(zhi)责分别(bie)负责)

  (十二)依法(fa)追究违(wei)法(fa)失信责(ze)任。建立(li)健(jian)全责(ze)任追究机(ji)制,对被列入失信联合惩(cheng)戒对象(xiang)名单的(de)市场主体,依法(fa)依规对其法(fa)定代(dai)表人(ren)或主要(yao)(yao)负责(ze)人(ren)、实际(ji)控制人(ren)进行失信惩(cheng)戒,并将(jiang)相关失信行为(wei)(wei)记(ji)入其个人(ren)信用(yong)记(ji)录。机(ji)关事业(ye)单位、国有企业(ye)出(chu)现(xian)违(wei)法(fa)失信行为(wei)(wei)的(de),要(yao)(yao)通报上级主管(guan)单位和审(shen)计部(bu)门;工作人(ren)员出(chu)现(xian)违(wei)法(fa)失信行为(wei)(wei)的(de),要(yao)(yao)通报所(suo)在单位及相关纪检监察、组织(zhi)人(ren)事部(bu)门。(各地区各部(bu)门按职责(ze)分(fen)别负责(ze))

  (十三)探索建(jian)立信(xin)(xin)(xin)(xin)用(yong)(yong)(yong)(yong)(yong)修(xiu)(xiu)复(fu)机制(zhi)。失信(xin)(xin)(xin)(xin)市场(chang)主(zhu)体在(zai)规定期限内纠正失信(xin)(xin)(xin)(xin)行为、消除(chu)不(bu)良影响的,可通过作出(chu)信(xin)(xin)(xin)(xin)用(yong)(yong)(yong)(yong)(yong)承(cheng)诺、完(wan)成(cheng)信(xin)(xin)(xin)(xin)用(yong)(yong)(yong)(yong)(yong)整改、通过信(xin)(xin)(xin)(xin)用(yong)(yong)(yong)(yong)(yong)核查、接受专题培训(xun)、提(ti)交信(xin)(xin)(xin)(xin)用(yong)(yong)(yong)(yong)(yong)报(bao)告、参加(jia)公益慈(ci)善活动(dong)等(deng)方(fang)式开展(zhan)信(xin)(xin)(xin)(xin)用(yong)(yong)(yong)(yong)(yong)修(xiu)(xiu)复(fu)。修(xiu)(xiu)复(fu)完(wan)成(cheng)后,各(ge)(ge)地区(qu)各(ge)(ge)部门要按程(cheng)序及时停止公示其失信(xin)(xin)(xin)(xin)记录(lu),终止实施联合(he)惩戒措(cuo)施。加(jia)快建(jian)立完(wan)善协同联动(dong)、一(yi)网通办(ban)机制(zhi),为失信(xin)(xin)(xin)(xin)市场(chang)主(zhu)体提(ti)供高效便捷(jie)的信(xin)(xin)(xin)(xin)用(yong)(yong)(yong)(yong)(yong)修(xiu)(xiu)复(fu)服务(wu)(wu)。鼓励符(fu)合(he)条件的第三方(fang)信(xin)(xin)(xin)(xin)用(yong)(yong)(yong)(yong)(yong)服务(wu)(wu)机构(gou)向失信(xin)(xin)(xin)(xin)市场(chang)主(zhu)体提(ti)供信(xin)(xin)(xin)(xin)用(yong)(yong)(yong)(yong)(yong)报(bao)告、信(xin)(xin)(xin)(xin)用(yong)(yong)(yong)(yong)(yong)管理咨(zi)询等(deng)服务(wu)(wu)。(发展(zhan)改革委牵(qian)头,各(ge)(ge)地区(qu)各(ge)(ge)部门按职责(ze)分别负责(ze))

  五、强(qiang)化信(xin)用监管的支撑保障

  (十四)着力提升(sheng)信(xin)(xin)(xin)(xin)(xin)(xin)(xin)用(yong)(yong)(yong)监管信(xin)(xin)(xin)(xin)(xin)(xin)(xin)息(xi)(xi)(xi)(xi)化建设水平。充分发(fa)挥全国信(xin)(xin)(xin)(xin)(xin)(xin)(xin)用(yong)(yong)(yong)信(xin)(xin)(xin)(xin)(xin)(xin)(xin)息(xi)(xi)(xi)(xi)共(gong)(gong)享平台和(he)(he)国家“互(hu)联(lian)(lian)网+监管”系统信(xin)(xin)(xin)(xin)(xin)(xin)(xin)息(xi)(xi)(xi)(xi)归(gui)集共(gong)(gong)享作用(yong)(yong)(yong),对(dui)政(zheng)府部门信(xin)(xin)(xin)(xin)(xin)(xin)(xin)用(yong)(yong)(yong)信(xin)(xin)(xin)(xin)(xin)(xin)(xin)息(xi)(xi)(xi)(xi)做到(dao)“应归(gui)尽归(gui)”,推进地方(fang)信(xin)(xin)(xin)(xin)(xin)(xin)(xin)用(yong)(yong)(yong)信(xin)(xin)(xin)(xin)(xin)(xin)(xin)息(xi)(xi)(xi)(xi)平台、行业信(xin)(xin)(xin)(xin)(xin)(xin)(xin)用(yong)(yong)(yong)信(xin)(xin)(xin)(xin)(xin)(xin)(xin)息(xi)(xi)(xi)(xi)系统互(hu)联(lian)(lian)互(hu)通(tong),畅通(tong)政(zheng)企(qi)数据(ju)(ju)流通(tong)机(ji)制,形成全面(mian)覆(fu)盖各地区(qu)各部门、各类市(shi)(shi)场(chang)主(zhu)体(ti)的(de)信(xin)(xin)(xin)(xin)(xin)(xin)(xin)用(yong)(yong)(yong)信(xin)(xin)(xin)(xin)(xin)(xin)(xin)息(xi)(xi)(xi)(xi)“一(yi)张(zhang)网”。依托全国信(xin)(xin)(xin)(xin)(xin)(xin)(xin)用(yong)(yong)(yong)信(xin)(xin)(xin)(xin)(xin)(xin)(xin)息(xi)(xi)(xi)(xi)共(gong)(gong)享平台和(he)(he)国家“互(hu)联(lian)(lian)网+监管”系统,将市(shi)(shi)场(chang)主(zhu)体(ti)基(ji)础信(xin)(xin)(xin)(xin)(xin)(xin)(xin)息(xi)(xi)(xi)(xi)、执法监管和(he)(he)处置(zhi)信(xin)(xin)(xin)(xin)(xin)(xin)(xin)息(xi)(xi)(xi)(xi)、失信(xin)(xin)(xin)(xin)(xin)(xin)(xin)联(lian)(lian)合惩戒(jie)信(xin)(xin)(xin)(xin)(xin)(xin)(xin)息(xi)(xi)(xi)(xi)等与相关部门业务系统按需共(gong)(gong)享,在信(xin)(xin)(xin)(xin)(xin)(xin)(xin)用(yong)(yong)(yong)监管等过程中加(jia)以应用(yong)(yong)(yong),支撑形成数据(ju)(ju)同(tong)(tong)步、措(cuo)施统一(yi)、标准(zhun)一(yi)致的(de)信(xin)(xin)(xin)(xin)(xin)(xin)(xin)用(yong)(yong)(yong)监管协同(tong)(tong)机(ji)制。(发(fa)展改革委、国务院办公厅(ting)牵头,各地区(qu)各部门按职(zhi)责(ze)分别(bie)负责(ze))

  (十五)大(da)力推进(jin)信(xin)用(yong)监管(guan)信(xin)息(xi)(xi)公(gong)开公(gong)示。在(zai)(zai)行(xing)政(zheng)许可、行(xing)政(zheng)处罚信(xin)息(xi)(xi)集中(zhong)(zhong)公(gong)示基础上,依(yi)托“信(xin)用(yong)中(zhong)(zhong)国(guo)”网(wang)站、中(zhong)(zhong)国(guo)政(zheng)府网(wang)或其他渠(qu)道(dao),进(jin)一步研究推动(dong)行(xing)政(zheng)强制、行(xing)政(zheng)确认、行(xing)政(zheng)征收(shou)、行(xing)政(zheng)给付、行(xing)政(zheng)裁(cai)决、行(xing)政(zheng)补(bu)偿、行(xing)政(zheng)奖励和(he)行(xing)政(zheng)监督检(jian)查等其他行(xing)政(zheng)行(xing)为信(xin)息(xi)(xi)7个工作日内上网(wang)公(gong)开,推动(dong)在(zai)(zai)司法(fa)裁(cai)判和(he)执行(xing)活(huo)动(dong)中(zhong)(zhong)应(ying)当(dang)公(gong)开的失信(xin)被执行(xing)人、虚(xu)假(jia)诉讼失信(xin)人相关信(xin)息(xi)(xi)通过适(shi)当(dang)渠(qu)道(dao)公(gong)开,做(zuo)到“应(ying)公(gong)开、尽公(gong)开”。(各地(di)区各部(bu)门按(an)职责(ze)分别负责(ze))

  (十六)充分(fen)发(fa)挥“互(hu)联(lian)(lian)网+”、大(da)(da)数(shu)(shu)(shu)据(ju)(ju)对(dui)信(xin)(xin)(xin)(xin)用(yong)(yong)监(jian)(jian)管(guan)(guan)(guan)的(de)(de)支撑作用(yong)(yong)。依(yi)(yi)托国家“互(hu)联(lian)(lian)网+监(jian)(jian)管(guan)(guan)(guan)”等(deng)系统(tong),有(you)效整合公(gong)共(gong)信(xin)(xin)(xin)(xin)用(yong)(yong)信(xin)(xin)(xin)(xin)息(xi)(xi)、市(shi)场(chang)信(xin)(xin)(xin)(xin)用(yong)(yong)信(xin)(xin)(xin)(xin)息(xi)(xi)、投诉举报信(xin)(xin)(xin)(xin)息(xi)(xi)和(he)互(hu)联(lian)(lian)网及第三方(fang)相关信(xin)(xin)(xin)(xin)息(xi)(xi),充分(fen)运(yun)用(yong)(yong)大(da)(da)数(shu)(shu)(shu)据(ju)(ju)、人(ren)工(gong)智能等(deng)新(xin)一代信(xin)(xin)(xin)(xin)息(xi)(xi)技术,实(shi)(shi)(shi)现(xian)信(xin)(xin)(xin)(xin)用(yong)(yong)监(jian)(jian)管(guan)(guan)(guan)数(shu)(shu)(shu)据(ju)(ju)可(ke)比对(dui)、过程可(ke)追溯、问题(ti)可(ke)监(jian)(jian)测。鼓励(li)(li)各地区各部门结(jie)合实(shi)(shi)(shi)际,依(yi)(yi)法(fa)依(yi)(yi)规(gui)(gui)与大(da)(da)数(shu)(shu)(shu)据(ju)(ju)机构合作开发(fa)信(xin)(xin)(xin)(xin)用(yong)(yong)信(xin)(xin)(xin)(xin)息(xi)(xi),及时动态(tai)掌握市(shi)场(chang)主(zhu)体经营情况及其规(gui)(gui)律特征。充分(fen)利用(yong)(yong)国家“互(hu)联(lian)(lian)网+监(jian)(jian)管(guan)(guan)(guan)”等(deng)系统(tong)建立(li)风(feng)险(xian)预(yu)(yu)判预(yu)(yu)警机制,及早发(fa)现(xian)防(fang)(fang)范(fan)苗头性和(he)跨行业跨区域风(feng)险(xian)。运(yun)用(yong)(yong)大(da)(da)数(shu)(shu)(shu)据(ju)(ju)主(zhu)动发(fa)现(xian)和(he)识别违(wei)(wei)法(fa)违(wei)(wei)规(gui)(gui)线索,有(you)效防(fang)(fang)范(fan)危害(hai)公(gong)共(gong)利益和(he)群众生命财产(chan)安全(quan)的(de)(de)违(wei)(wei)法(fa)违(wei)(wei)规(gui)(gui)行为。鼓励(li)(li)通过物(wu)联(lian)(lian)网、视(shi)联(lian)(lian)网等(deng)非接触式(shi)监(jian)(jian)管(guan)(guan)(guan)方(fang)式(shi)提升执法(fa)监(jian)(jian)管(guan)(guan)(guan)效率,实(shi)(shi)(shi)现(xian)监(jian)(jian)管(guan)(guan)(guan)规(gui)(gui)范(fan)化、精准化、智能化,减少人(ren)为因素,实(shi)(shi)(shi)现(xian)公(gong)正监(jian)(jian)管(guan)(guan)(guan),杜绝随意检查、多头监(jian)(jian)管(guan)(guan)(guan)等(deng)问题(ti),实(shi)(shi)(shi)现(xian)“进一次门、查多项(xiang)事”,减少对(dui)监(jian)(jian)管(guan)(guan)(guan)对(dui)象的(de)(de)扰动。(国务院办公(gong)厅、发(fa)展(zhan)改革委、市(shi)场(chang)监(jian)(jian)管(guan)(guan)(guan)总局牵(qian)头,各部门按职责分(fen)别负(fu)责)

  (十七)切实加大信(xin)(xin)(xin)(xin)(xin)用(yong)(yong)信(xin)(xin)(xin)(xin)(xin)息(xi)(xi)安全和(he)(he)市(shi)(shi)场主体权益保护(hu)力(li)度。严(yan)肃查(cha)处(chu)违规(gui)泄露(lu)、篡改(gai)信(xin)(xin)(xin)(xin)(xin)用(yong)(yong)信(xin)(xin)(xin)(xin)(xin)息(xi)(xi)或(huo)利(li)用(yong)(yong)信(xin)(xin)(xin)(xin)(xin)用(yong)(yong)信(xin)(xin)(xin)(xin)(xin)息(xi)(xi)谋(mou)私等行为。加强(qiang)信(xin)(xin)(xin)(xin)(xin)用(yong)(yong)信(xin)(xin)(xin)(xin)(xin)息(xi)(xi)安全基(ji)础设施和(he)(he)安全防护(hu)能力(li)建设。建立健全信(xin)(xin)(xin)(xin)(xin)用(yong)(yong)信(xin)(xin)(xin)(xin)(xin)息(xi)(xi)异(yi)议投诉制度,对(dui)市(shi)(shi)场主体提出异(yi)议的信(xin)(xin)(xin)(xin)(xin)息(xi)(xi),信(xin)(xin)(xin)(xin)(xin)息(xi)(xi)提供和(he)(he)采(cai)集单位(wei)要尽快核实并反馈(kui)结(jie)果(guo),经核实有(you)(you)误的信(xin)(xin)(xin)(xin)(xin)息(xi)(xi)要及时予以更正或(huo)撤销。因(yin)错(cuo)误认定失信(xin)(xin)(xin)(xin)(xin)联(lian)合惩戒对(dui)象名单、错(cuo)误采(cai)取失信(xin)(xin)(xin)(xin)(xin)联(lian)合惩戒措(cuo)施损害市(shi)(shi)场主体合法权益的,有(you)(you)关(guan)部门和(he)(he)单位(wei)要积(ji)极采(cai)取措(cuo)施消除不(bu)良(liang)影响。(各(ge)地区各(ge)部门按职责(ze)分别(bie)负责(ze))

  (十八)积极引(yin)导(dao)(dao)行(xing)(xing)业组织和(he)信(xin)(xin)(xin)(xin)用(yong)(yong)(yong)服(fu)(fu)务机(ji)(ji)构(gou)协(xie)(xie)同监(jian)(jian)管(guan)。支持有(you)关部门授权的行(xing)(xing)业协(xie)(xie)会(hui)商(shang)(shang)会(hui)协(xie)(xie)助开展(zhan)行(xing)(xing)业信(xin)(xin)(xin)(xin)用(yong)(yong)(yong)建设(she)和(he)信(xin)(xin)(xin)(xin)用(yong)(yong)(yong)监(jian)(jian)管(guan),鼓励(li)行(xing)(xing)业协(xie)(xie)会(hui)商(shang)(shang)会(hui)建立会(hui)员(yuan)信(xin)(xin)(xin)(xin)用(yong)(yong)(yong)记录(lu),开展(zhan)信(xin)(xin)(xin)(xin)用(yong)(yong)(yong)承诺、信(xin)(xin)(xin)(xin)用(yong)(yong)(yong)培(pei)训、诚信(xin)(xin)(xin)(xin)宣传、诚信(xin)(xin)(xin)(xin)倡议(yi)等(deng),将诚信(xin)(xin)(xin)(xin)作为行(xing)(xing)规(gui)行(xing)(xing)约重(zhong)要内(nei)容(rong),引(yin)导(dao)(dao)本行(xing)(xing)业增强(qiang)依法诚信(xin)(xin)(xin)(xin)经(jing)营意识。推(tui)动征信(xin)(xin)(xin)(xin)、信(xin)(xin)(xin)(xin)用(yong)(yong)(yong)评级、信(xin)(xin)(xin)(xin)用(yong)(yong)(yong)保险、信(xin)(xin)(xin)(xin)用(yong)(yong)(yong)担保、履约担保、信(xin)(xin)(xin)(xin)用(yong)(yong)(yong)管(guan)理咨询(xun)及培(pei)训等(deng)信(xin)(xin)(xin)(xin)用(yong)(yong)(yong)服(fu)(fu)务发展(zhan),切实发挥(hui)第(di)三方(fang)信(xin)(xin)(xin)(xin)用(yong)(yong)(yong)服(fu)(fu)务机(ji)(ji)构(gou)在(zai)信(xin)(xin)(xin)(xin)用(yong)(yong)(yong)信(xin)(xin)(xin)(xin)息采集(ji)、加工、应(ying)用(yong)(yong)(yong)等(deng)方(fang)面的专业作用(yong)(yong)(yong)。鼓励(li)相关部门与第(di)三方(fang)信(xin)(xin)(xin)(xin)用(yong)(yong)(yong)服(fu)(fu)务机(ji)(ji)构(gou)在(zai)信(xin)(xin)(xin)(xin)用(yong)(yong)(yong)记录(lu)归集(ji)、信(xin)(xin)(xin)(xin)用(yong)(yong)(yong)信(xin)(xin)(xin)(xin)息共享、信(xin)(xin)(xin)(xin)用(yong)(yong)(yong)大数据分(fen)析、信(xin)(xin)(xin)(xin)用(yong)(yong)(yong)风险预警、失信(xin)(xin)(xin)(xin)案例核(he)查、失信(xin)(xin)(xin)(xin)行(xing)(xing)为跟踪(zong)监(jian)(jian)测等(deng)方(fang)面开展(zhan)合作。(发展(zhan)改革委、民政部、人民银行(xing)(xing)按职责分(fen)别负(fu)责)

  六(liu)、加强信用监管的组织实施

  (十九)加强组(zu)织(zhi)领导。各地区(qu)各部门要(yao)把构建(jian)以(yi)信用(yong)(yong)(yong)(yong)为(wei)基(ji)础的(de)新型(xing)监管(guan)(guan)机制作为(wei)深入推进(jin)“放管(guan)(guan)服”改(gai)革的(de)重要(yao)举措,摆在更加突出的(de)位置,加强组(zu)织(zhi)领导,细化责(ze)任分工,有(you)力(li)有(you)序有(you)效推动落实。完善信用(yong)(yong)(yong)(yong)监管(guan)(guan)的(de)配套(tao)制度(du),并加强与(yu)其他(ta)“放管(guan)(guan)服”改(gai)革事项(xiang)的(de)衔接。负有(you)市场监管(guan)(guan)、行业(ye)监管(guan)(guan)职责(ze)的(de)部门要(yao)切实承担行业(ye)信用(yong)(yong)(yong)(yong)建(jian)设和(he)信用(yong)(yong)(yong)(yong)监管(guan)(guan)的(de)主体责(ze)任,充分发(fa)(fa)挥行业(ye)组(zu)织(zhi)、第三方(fang)信用(yong)(yong)(yong)(yong)服务机构作用(yong)(yong)(yong)(yong),为(wei)公众监督创造有(you)利条件,整合形成(cheng)全社会共同参与(yu)信用(yong)(yong)(yong)(yong)监管(guan)(guan)的(de)强大合力(li)。(发(fa)(fa)展改(gai)革委牵头(tou),各地区(qu)各部门按(an)职责(ze)分别负责(ze))

  (二(er)十一(yi)(yi)(yi))加快(kuai)建章立制。推动制定社会(hui)信(xin)用(yong)(yong)体系建设相关法律,加快(kuai)研究出台(tai)公共信(xin)用(yong)(yong)信(xin)息管(guan)理条例、统(tong)一(yi)(yi)(yi)社会(hui)信(xin)用(yong)(yong)代码(ma)管(guan)理办法等法规。建立健全全国统(tong)一(yi)(yi)(yi)的(de)信(xin)用(yong)(yong)监管(guan)规则和标准(zhun),及时(shi)出台(tai)相关地方性法规、政府规章或规范(fan)性文件,将信(xin)用(yong)(yong)监管(guan)中(zhong)行之有效的(de)做法上升为制度规范(fan)。抓紧制定开展信(xin)用(yong)(yong)监管(guan)急需的(de)国家标准(zhun)。(发(fa)展改革委、司法部(bu)牵头(tou),各地区(qu)各部(bu)门按(an)职责分(fen)别负责)

  (二十(shi)二)做(zuo)好宣(xuan)传解(jie)(jie)读(du)(du)。各地(di)区各部门要通过各种(zhong)渠道和(he)形式,深入细(xi)致向市(shi)场主体做(zuo)好政策宣(xuan)传解(jie)(jie)读(du)(du)工(gong)作,让经营(ying)者(zhe)充分(fen)理(li)解(jie)(jie)并(bing)积极配(pei)合(he)以信用为(wei)基础的(de)新型监(jian)(jian)管(guan)措施。加强(qiang)对(dui)基层和(he)一线(xian)监(jian)(jian)管(guan)人员的(de)指导和(he)培训。组织新闻媒体广(guang)泛报道,积极宣(xuan)传信用监(jian)(jian)管(guan)措施及其成效(xiao),营(ying)造良好社会氛围。(发展改革(ge)委牵头,各地(di)区各部门按职责分(fen)别负责)
